Kupeli & others v (1) Kibris Turk Hava Yollari Sirketi (2) Atlasjet Havacilik Anonim Sirketi [2016] EWHC 930 (QB)

Hudson Morgan Williams were instructed by 838 Claimants to represent claims against Cyprus Turkish Airlines and Atlas Jet Airlines.

The claims were made on multiple basis, the primary ones being that the Atlas Jet were in breach of contract by failing to provide replacement flights and/or cancelling reservations which were made on Atlas Jet’s replacement flights; and failing to provide compensation to Claimants which they were owed under the Denied Boarding Regulations (EC 261/2004).

This was a ground breaking case spanning over 8 years and involved immensely complex matters such as multiple jurisdictional issues, recognition by UK law of contractual documentation between Northern Cyprus government and Atlas Jet airlines, involved multiple categories of Claimants and Hudson Morgan Williams successfully handled multiple tactical applications made by the Defendant to resist the matter from going to trial.

Hudson Morgan Williams presented well-structured arguments and produced evidence to establish that an international airline’s own documentary records, its systems and its witnesses were unreliable in a 13 day trial at the High Court.
