Hudson Morgan Williams was instructed to make a permission to appeal against a Judgment made against the Defendant.
The facts of the case were that a lottery ticket was bought for the Euromillions lottery which then successfully won the £1 million prize. The dispute arose as to ownership of the ticket and who was in fact entitled to the winnings. Judge Gosnell decided that the Claimant and Defendant entered a Contract to jointly play the lottery on an equal basis. He concluded they must share the prize half and half. The Defendant contended that the Judge had failed to review the full material available to him and thereby was unable to make a fair and proper assessment. As a result that omission had led him to the wrong conclusion. The facts of this case were unusual. It was common ground that a winning ticket in Euro millions was bought because of a dream by the Claimant. As the Judge held in paragraph 1 of the Judgment, the Claimant “is a strong believer in the power of dreams”. Permission to appeal was made base of whether a dream is evidence.
